TERMS & CONDITIONS – FLORA DE MARIS
Welcome to Flora de Maris. By accessing our website and/or placing an order, you agree to be bound by the following Terms & Conditions. Please read them carefully before purchasing.
1. GENERAL
- These Terms & Conditions apply to all offers, orders, and agreements made via the Flora de Maris website.
- Flora de Maris reserves the right to update or modify these Terms at any time. The version in effect at the time of purchase applies to your order.
- If any provision of these Terms is found to be invalid, the remaining provisions will remain in full force and effect.
2. COMPANY INFORMATION
Flora de Maris is an independent swimwear brand based in the Netherlands.

3. PRODUCTS
- All products are handmade or produced in small batches. Minor variations in color, texture, lace placement or finishing may occur and are considered part of the uniqueness of each piece.
- Product images are for illustrative purposes only. Colors may appear differently depending on screen settings.
- We reserve the right to modify or discontinue products at any time without prior notice.
4. PRICING
- All prices are listed in euros (€) and include VAT unless otherwise stated.
- Shipping costs are displayed at checkout.
- Flora de Maris reserves the right to change prices at any time. Price changes do not affect confirmed orders.
5. ORDERS
- An order is confirmed once payment has been successfully completed and an order confirmation has been sent.
- We reserve the right to refuse or cancel orders in case of suspected fraud, misuse, or pricing/technical errors.
- In such cases, any payment already made will be refunded.
6. PAYMENTS
- Payments must be completed using the available payment methods at checkout.
- Orders are processed only after full payment has been received.
- All payments are processed securely via third-party providers. We do not store payment details.
7. PRODUCTION & PROCESSING TIME
- As products are handmade or produced in limited batches, a processing time of up to 5 working days may apply before shipment.
- Processing times are estimates and may vary during busy periods such as launches or sales.
8. SHIPPING & DELIVERY
- Orders are shipped to the address provided by the customer. It is the customer’s responsibility to ensure all information is correct.
- Once the order has been handed over to the shipping carrier, risk of loss or damage passes to the customer upon delivery.
- A tracking code will be provided for all shipments.
- Flora de Maris is not responsible for delays caused by carriers, customs, or other external factors beyond our control.
9. RIGHT OF WITHDRAWAL & RETURNS (EU LAW)
Customers within the European Union have the right to withdraw from their purchase within 14 days of receiving the order, in accordance with EU consumer law.
Hygiene Exception (Swimwear)
Due to hygiene reasons, swimwear items may only be returned if:
- The item is unworn, unwashed, unused, and in original condition
- All original tags are attached
- The hygiene seal is intact and has not been removed or tampered with
If the hygiene seal is broken or removed, the item is no longer eligible for return.
Return Conditions
- Returns must be requested within 14 days of receiving the order
- Items must be returned in their original condition
- Return shipping costs are the responsibility of the customer, unless the item is faulty or incorrectly delivered
- Refunds are processed once the returned item has been received and inspected
Faulty Items
Any defective or incorrect items must be reported within 48 hours of delivery, including clear photographic evidence.
We reserve the right to refuse returns that do not meet these conditions.
10. DAMAGED OR LOST PACKAGES
- Any damage must be reported within 24 hours of delivery with photographic proof.
- Packaging must be retained until the claim is resolved.
- If tracking confirms delivery, Flora de Maris is not responsible for loss, theft, or missing packages after delivery.
11. LIABILITY
- Flora de Maris is not liable for indirect damages such as loss of income, missed opportunities, or consequential damages.
- We are not responsible for damages resulting from improper use of products.
- Our maximum liability is limited to the value of the purchased order.
12. INTELLECTUAL PROPERTY
All content on this website, including designs, images, text, and branding, is the intellectual property of Flora de Maris and may not be copied, reproduced, or used without written permission.
13. PRIVACY
Please refer to our Privacy Policy for details on how we collect and process personal data.
14. FORCE MAJEURE
Flora de Maris is not responsible for delays or failure to perform due to circumstances beyond our control, including but not limited to natural disasters, strikes, illness, supply chain disruptions, or shipping delays.
15. GOVERNING LAW
These Terms & Conditions are governed by Dutch law. Any disputes shall be submitted to the competent court in the Netherlands.
